Employment Law

The state and federal laws concerning employment are constantly changing, creating expanded risks and liabilities for employers. The Employment Law Practice Group at LeVander, Gillen & Miller, P.A. makes sure that your business or organization is kept current with the changing laws, and that all of your employment law needs are served in an organized and cost-effective manner. Whether it be drafting policies related to sexual harassment, internet use, or discipline; investigating or responding to employee complaints; reviewing or writing employee manuals; or drafting non-compete, non-solicitation, confidentiality, employment, and severance agreements, our experienced and knowledgeable employment attorneys help you navigate through the complex and shifting employment environment to ensure that your business or organization is compliant with all state and federal laws.

We work closely with our clients to answer the everyday questions facing employers, such as "Is it okay to do this?" and "What are the potential consequences of this decision?" Our attorneys advise you on the course of action to take, as well as the risks associated with that course of action. With proper employment policies and advice, you can prevent unwarranted claims, meet the requirements of the law, and avoid the common pitfalls associated with hiring, discipline, and termination.

Although prevention is our primary goal, there are situations in which litigation cannot be avoided. In those cases, our team of experienced trial attorneys provides you with aggressive and effective litigation representation and dispute resolution.

The attorneys of the Employment Law Practice Group are available to assist your organization with all aspects of the employment relationship, including but not limited to:

Defining the Employment Relationship ~ Defining the nature of the employer/employee relationship at the outset of employment is critical in the prevention of employment issues. Our pre-employment counsel includes advice on the pitfalls of the hiring process, the creation of effective employment application forms, the crafting of lawful interview questions, and other helpful hiring techniques to help you identify, attract, and hire quality employees, as well as avoid costly mistakes. In addition, we draft employment, independent contractor, non-completion, non-solicitation, and confidentiality agreements that are tailored to the specific needs of your organization.

Maintaining the Employment Relationship ~ Once the employment relationship has been created, it is important to formally articulate your organization's policies and clearly delineate expectations in a uniform and consistent manner. Our attorneys work with you to review and/or draft employee manuals that are tailored to your business, while incorporating the provisions required by state and federal law. Throughout the employment relationship, we help you resolve wage and hour issues, advise you in handling difficult employee discipline issues, investigate employee complaints, and establish procedures and policies compliant with state and federal law. Our attorneys are readily available to provide fast and accurate answers to your questions and provide sound advice as soon as a situation arises.

Ending the Employment Relationship ~ Should it become necessary to terminate the employment relationship, our attorneys assist you in carefully handling employee discipline and termination issues, including the proper documentation of disciplinary action and the drafting of severance agreements and releases. We also work with you to enforce non-competition, non-solicitation, and confidentiality agreements against former employees, and we will vigorously defend you against claims brought under Title VII, the Minnesota Human Rights Act, the Americans with Disabilities Act, the Age Discrimination in Employment Act, the Family and Medical Leave Act, and any other state or federal employment law.

As experienced employment law attorneys, we know the importance of preventative counsel, policy and procedure implementation, employer education, solid contract drafting, and skilled conflict resolution. The attorneys at LeVander, Gillen & Miller, P.A. do more than solve employment problems for our employer clients - we work with you to prevent them.
